On Tuesday, September 15, 2009, California Governor Arnold Schwarzenegger signed Executive Order S-21-09 directing the state's Air Resources Board (ARB) to adopt regulations increasing California's Renewable Portfolio Standard (RPS) to 33 percent by 2020. The executive order provides more guidance to state regulators about how to achieve the requirement than Governor Schwarzenegger’s 2008 order establishing the 33 percent goal. The order comes a few days after the state legislature also passed bills with a 33 percent requirement for renewables; however, it is not yet clear whether these bills will become law.
The executive order allows renewable energy imported from "resources and facilities" in states throughout the Western Interconnection, the power grid in the West, to count towards the RPS target. The RPS will apply to all load serving entities, including investor-owned utilities, publicly-owned utilities, direct access providers and community choice aggregators. The ARB is directed to adopt these regulations by July 31, 2010.
California has an interim mandate that 20 percent of the state’s electricity come from renewables and energy efficiency by 2010.
